Terms of Service

1. Acceptance of Terms

By accessing or using NerdPortal ("the Service"), operated by UniFi Nerds ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We reserve the right to update these terms at any time, and continued use of the Service after changes constitutes acceptance of the revised terms.

2. Description of Service

NerdPortal is a cloud-based captive portal management platform designed for Ubiquiti UniFi network products. The Service allows businesses to create branded guest WiFi portals, capture visitor information, manage guest access, and analyze usage data. Features and availability may vary depending on your subscription plan.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use. You must be at least 18 years old or the age of majority in your jurisdiction to create an account.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service to: collect data without proper consent from end users; transmit spam, malware, or harmful content through your portal; attempt to gain unauthorized access to our systems or other users' accounts; resell or redistribute the Service without our written consent; or use the Service in any way that violates applicable laws or regulations.

5. Intellectual Property

The Service, including its design, code, features, and documentation, is owned by UniFi Nerds and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service. You retain ownership of any content, branding assets, or data you upload to the Service.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data and the data of your portal visitors. You are responsible for ensuring that your use of the Service complies with all applicable data protection laws, including providing appropriate privacy notices to your end users.

7. Service Level Agreement

We strive to maintain 99.9% uptime for the Service. Scheduled maintenance windows will be communicated in advance when possible. We are not liable for downtime caused by factors beyond our reasonable control, including internet outages, third-party service failures, or force majeure events. Enterprise plan customers may be eligible for SLA credits as outlined in their service agreement.

8. Limitation of Liability

To the maximum extent permitted by law, UniFi Nerds shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Termination

Either party may terminate the subscription at any time. You may cancel your account through the dashboard or by contacting support. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after termination, after which it may be permanently deleted.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in Hillsborough County, Florida.
